This Terms of Service is a legal agreement between you and Talk 2 Me. The following Terms of Service govern your use of the Talk 2 Me website and all products and services offered. If you do not agree to these Terms, you are not authorized to access or use the Talk 2 Me web site or services. By using our services, you agree to be bound by these Terms.

1. Account Responsibilities & Usage

• Any illegal use of the service is strictly prohibited, including messages containing racist or discriminatory content, or harassment to an individual or organization.
• You are responsible for the privacy and storage of your login credentials. All activities traced to your account are legally binding to you.
• You accept full responsibility for your message content. Talk 2 Me does not assume any liability for the content of messages sent through our widget. You exempt Talk 2 Me from any claim that may arise from third parties as a result of message content.

2. Service Delivery & Limitations

Talk 2 Me delivers the service via major cloud and telecommunications providers. We neither claim nor guarantee absolute 100% availability or performance. While Talk 2 Me makes every effort to deliver messages promptly, we accept no liability for transmission delays, internet outages, or message failures. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. You use the service entirely at your own risk.

3. Privacy & Data

In accordance with legal requirements, usage data is recorded for the necessary purposes of maintaining the messaging service. You guarantee every end user the right to object to your processing of personal data relating to them. Talk 2 Me is firmly committed to protecting the privacy of your personal information and the personal information of your customers, governed by our Privacy Policy.

4. Intellectual Property & Restrictions

Talk 2 Me is the sole owner of the Service including all applicable copyrights, patents, trademarks, and trade secrets. You are granted a non-exclusive, non-transferable, limited license to use the Software solely for accessing the Service.

You agree NOT to:

• Sell or resell the services we provide.
• Copy, reverse engineer, disassemble, modify, decompile, or make copies of the Service.
• Impersonate any other person, entity, or Talk 2 Me official.
• Send unsolicited bulk e-mail (spam) utilizing our service links.
• Modify or alter the widget outside of the scope of the customization options available in the dashboard.

5. Payments & Refunds

No refunds or credits for Subscription Charges or other fees will be provided if you elect to downgrade or cancel your service plan. Downgrading your Service Plan may cause loss of content, features, or capacity, and Talk 2 Me does not accept any liability for such loss.

6. Limitation of Liability & Indemnification

You agree to defend, indemnify, and hold harmless Talk 2 Me, its officers, directors, employees, and agents from any third-party claims, actions, or demands arising from your use of the services or violation of these Terms.

Talk 2 Me will not be liable to you or any third party for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages of any kind, including loss of income, data, or business reputation. In no event shall Talk 2 Me's maximum aggregate liability exceed the total amount paid by you for the services, but in no event greater than five hundred dollars ($500.00).

7. Modifications to Service

Talk 2 Me reserves the right to modify, alter, suspend, or discontinue all or any portion of the web site and/or services at any time in its sole discretion for any reason, without notice or liability.
